On The Protection Of Legal Rights Of Denaturalized Persons

The first Sex-change Surgery (SCS) in China was operated at 1984, but the first public SCS was reported at 1990. Later, the SCS has a great development. It is estimated that there are 400,000 people need SCS. The media gradually increases regarding on SCS and Denaturalized Person, and more than 1000 people has been operated with SCS. So they become a Special community. They have different experience and Psychological condition, and there are many problems on laws because of their Special status. Because Present law are not enough to adjust Denaturalized Person, which will lead chaotic in law, and the Denaturalized Persons' rights also cannot be protected completely.Transsexualism is a special disease, and there is not a conclusion about its pathogeny. The first part of the article introduces the reason why people want to change their sex, including Transsexualism, homosexuality and other reasons. Then, I talk about the problem caused by person who has been operated with SCS, including the rules of SCS, the changes of Denaturalized Persons' name and ID, and many marriage problems caused by Denaturalized Person.The second part analyzes the problems caused by Denaturalized Person from constitution angle. Firstly, it is the body rights and rules of SCS; secondly, it is the Denaturalized Persons' right of privacy and others' right to know, and analyzes how can we decrease the damages caused by the conflict of the two kinds of rights. Thirdly, I talked about the Freedom of marriage and other legal problem of Denaturalized Persons. Lastly, it is the labor employment of Denaturalized Person, and countermeasures against employment discrimination.The third part introduce the foreign legal systems about Denaturalized Persons and SCS, including the changes of Denaturalized Persons' name and ID , many marriage problems caused by Denaturalized Person and other rules. Legal system of USA, Brazil, Japan, Swiss, Holland and Chinese Taiwan will show in this part.The fourth part includes the actual life of Denaturalized Persons in China and some suggestions about legislation on Denaturalized Persons, Including the Present situation of Chinese SCS, and point out the Vacancy in this field. And then, I introduce the living condition of Denaturalized Persons by two examples. Lastly, the article discuss the two details in Chinese legal system, which are whether the Transsexualism should get divorce before SCS or not and the care to Denaturalized Person after SCS.
