Constitutional Guarantee Of Citizens’ Environmental Rights

Citizens’ environmental rights were proposed in the 1950 s and 1960 s.After more than ten years of development,many countries in the world have made it clear in their constitutions.At present,my country’s constitutional provisions have not clearly stipulated citizens’ environmental rights.Since the reform and opening up,my country’s economy has continued to take off,and environmental problems have become more serious.As my country’s awareness of governing the country in accordance with the constitution and building ecological civilization has increased,citizens’ environmental rights as a basic human right must be included in the constitution.Therefore,this article focuses on the constitutional protection of citizens’ environmental rights in our country.The full text starts from four parts: The first part first introduces the basic theories of citizens’ environmental rights constitutional protection in detail,sorts out the background and historical development context of citizens’ environmental rights,and analyzes The attributes of citizens’ environmental rights are summarized through different theories and viewpoints that citizens’ environmental rights are an independent basic human right.The second part of this article takes the comparative analysis method as the perspective to study the concepts and practical experiences of the constitutional protection of advanced citizens’ environmental rights in foreign countries such as the United States,Japan,France and other countries.Useful and valuable experience.The third part explores the necessity and feasibility of constitutional protection of citizens’ environmental rights from the status quo and problems of citizens’ environmental rights in my country.The fourth part proposes the construction of the envisioning of citizens’ environmental rights into the constitution in the future,mainly from the constitution of citizens’ environmental rights.From the perspectives of the way,the established position,and the effectiveness of the constitution.At present,the environmental problems facing our country are still very serious.A right that is not stipulated by the constitution is difficult to implement in real life.Therefore,it is still urgent to stipulate citizens’ environmental rights in the constitution,which demonstrates our country’s advocacy of environmental protection and the concept of environmental rule of law.Value,in response to the historical trend of the era of environmental rule of law,is the best embodiment of the protection of basic rights.
