With the development of knowledge economy and technological information, electronic monitoring is becoming more and more popular as a means of supervising in workplace. Most large and average enterprises and technological enterprises in domestic and abroad set electronic monitoring devices in workplace in order to avoid the unfaithful behavior and disclosure of trade secret ,so as to keep a high beneficial result and preserve the whole entity in a safe and efficient condition.There are some bases that the enterprises have the reason to adopt some electronic monitoring devices to supervise the employees in workplace. The enterprises as a subject in market economy; making profit is their core purpose. Otherwise the competitors will defeat them and at last they will be kept out of the market. For the sake to make money and conserve them sound, they need to maintain the workplace under their control, That is why more and more enterprises introduce electronic monitoring devices to their business.The employees who perform in the workplace still have some rights to keep them working in safe peaceful and respectable circumstances. That is the basic demand of the democracy and lawful society. As the application of the electronic monitoring, conflicts between the employees and employers become more and more intense. The tort litigation from the employees step up day after day, which is a significant problem, must be faced altitude.This article tries to find a solution to this question. It has analyzed some solutions and legislations of the developed countries, studied the reality of domestic enterprises. At last get the conclusions that in China we must resolve this question considering our national conditions and national culture. It suggests that we should put the proposals in the group labor contracts and company constitutions through the negotiation and discuss between the enterprises and representatives from the employees to come to a win-win result.With the advancement of the society, humankind will place more and more importance on privacy. As a main part of privacy, privacy in workplace will still be a key subject, which needs to be perfect day by day.
