Education is basic human rights around the whole world. But in china, this rights does not get suitable protection, especially equal opportunity, satisfying conditions, and friendly environment, which all suffer serious challenges. Currently, main problems are stagnant pre-education, unbalanced compulsory education, disordered middle education, and superficial post-education and even vocational education.At china, as lack of support from traditional history, education, although being written into code, has no direct relation with practical lives. In fact, protection to education is complex and comprehensive. To this dilemma, it is necessary to set up a correct attitude so as to ensure end results. At one hand, it must realize that education is not a tool or a reveal of materialism but a basic human rights and a welfare policy. In this sense, the scope of benefit should be as wide as possible. Next, the protection to educational rights should be ensured in policy rather than a temporary impulse. Sound legal system is the most important precondition. It must establish legitimate protection to compensate injured rights. Thirdly, sufficient materials are also indispensable. The protecting degree is related tiredly with economic development.
