Reform The System Of Reeducation Through Labour With The Socialist Concept Of The Rule Of Law

In recent years, the comrades engage in the real work or research into the work of the reeducation through labor, will be facing such an indisputable fact, that is, the serious lag in labor legislation and existing laws and regulations imperfections caused confusion and embarrassment. Especially with the "Criminal Law" "Legislation Law" and "Law on Administrative Pu- nishment"promulgate and implement ,the reeducation-through -labor dispute had also become worse. But if the two aspects of the theory and practice observated, you will find, although the name of reeducation-through-labor may make some adjustments, labor reeducation in decision-making process and implementation need to constantly improve (in fact founded with the inmates work in recent years has not stopped). But the time fundamentally repealing labor reeducation system is not ripe . Therefore,seeking reformation of the labor reeducation for the correct channel and effective measures from the actual work ,will be very important practical significance to improving our law and public order, strengthening of human rights protection, building a socialist harmonious society. With the point of view of the socialist concept of rule of law,the author analyse the conflict beteen the labor reeducation system in guaranteeing civil rights, safeguarding social stability and the existing laws , the abuse in the practical implementation.Eventually,the future reform of the system of reeducation through labor is proposaled.
