Reconstruction Of The New Situation Of China's Reeducation Through Labor System

The system of reeducation through labor is a legal system created with special historic conditions in China. But with the development of the society,for the crudeness in legislative regulations and for lack of regulatory procedure, especially《International Covenant on Civil and Political Rights》was signed by Chinese govment.This system with many problems in its enforcement has been constantly questioned about its legality, rationality and justification. The author gives an analysis on the problems of this system and present views and plans on how to reform this system.This chapter discusses the purpose and significance of the literature review,research,innovation,and the structure of the article ;Firstly,introduce the outline of the system of reeducation through labor; through the introduction of foreign legal systems of the system of reeducation through labor,the author analysis the current situation of the system of reeducation through labor, and propose the flaws of it. the author elaborates the relations between the system of reeducation through labor and protection of human rights. Then analysis the conflicts between the system of reeducation through labor and international human rights joint pledges. The argument about how to transform the system of reeducation through labor; In this chapter, the author introduce some different viewpoints about whether or not the system of reeducation through labor should be abolished, and how to transform the system of reeducation through labor. The author brings some feasibly suggestions about how to transform the system of reeducation through labor.The author express an outlook of the construction of system of the system of reeducation through labor.
