In fact, the gentle of the penalty is an overwhelming trend in the world, therefore the alleviation of fine penalty is also a trend, and we should pay much more attention to it.Meanwhile, the economic analysis has developed from the 1960s, as a new subject it introduced some ideas and theory into the legal field, and has witnessed a dramatic growth in the late decades. It not only finds a new scope of the research area, but also opened up the mind of legal scope.Although economy and law are quite different, they still share quite common ground, they are all doing researches on the human beings and their society. In the past, we only are in the pursuit of ideal legal effect and ignored whether it will be outcome or not. The economy itself is a subject which seeks for the maximum of efficiency, so the introduction will be of great significance to the law.This paper aims at bettering the fine penalty at the basis of macro and micro economic analysis. From the macro view, the thesis firstly clears the concept of cost and benefit, and then tries to find the best relations between them. Further, the paper discusses the pattern and intensity of the fine at existing condition.From the micro angle, the paper aims at analyzing fine penalty on the personal basic. It firstly demonstrates the best point of the fine in associated with a single person, and then it established several models concerning the cost of the fine penalty.In the last part, the paper discusses the controversy point of the equity and efficiency.
