On The Ecological Crime In China

Ecological resources are the essential basses of survival and development of human beings. However, with the development of industry and the improvement of the ability of human to change nature, ecological resources are in danger of overdraft. Overuse and overdevelopment of ecological resources have resulted in the worsen of environment, frequent occurrence of environmental accidents, losses and injuries of life, damage of property, broken of living space, and threat of survive. With the purpose to protect environment, counteract and punish the behaviors that harm ecological environment, ecological problems has changed into social problems, and"ecological crime"has become the new viewpoint in criminology study. The purpose of the research on occurrence and development of a series of crime is to prevent and control this kind of crime, which is the same to the study of ecological crime. Its ultimate aim is to grasp the characteristics of ecological crime, so as to build organic prevention and controlling system against this kind of crime, and to build a harmonious home for human.The first section focuses on the concept of ecology and ecological crime, and forms the whole concept of ecological crime. Then the author analyses the fundamental characteristics and status of ecological crime. From comparing among ecological crime, environmental crime and the crime of destroying nature resources, the author declares the character of ecological crime, and shows the necessary of raising the concept of ecological crime.The second section analyses the causes of ecological crime from the perspective of criminology and economics, and it comes that fault developing, benefit driving, management missing, law uncovering, and technology lagging are the reasons that lead to this.According to these reasons, the third section establishes a basic mode for prevention and controlling of ecological crime, namely"3A"mode. This mode is the basis of the process in preventing and controlling ecological crime, as well as the essential of this essay, which covers the aim, advices as a guide and actions for preventing and controlling ecological crime. This section puts great emphasis on expounding the specific measures, which can be divided into three parts: the prevention and controlling of guidance, strategy decision, and operating. The prevention and controlling of guidance includes fields of mental, strategy of state and legal system; the prevention and controlling of strategy decision includes the decisions of administration and management; and the prevention and controlling of operating includes technology innovation,ecological supervision and international collaboration. These three measures together form overall prevention and controlling system for ecological crime from three different aspects.This article pays much attention to the present situation of ecological crime in China nowadays. By systemically describing the concept and causes of ecological crime and how to prevent and control it, the author presents the research production about ecological crime and its controlling step by step.
