| With a long history and extensively adopted by the developed countries, Bankruptcy legal system has vital significance on promoting economic development as well as stabilizing society order. Along with our country's Reform and Open policy unceasing deepening, legal construction has been perfected continuously and tended to rationalize and internationalize. However, bankruptcy system is still relative backwardness. Until now, our country has not established our own bankruptcy legal system. The new Enterprise Bankruptcy Law of the People's Republic of China which was promulgated on August, 2006 extends the subject of bankruptcy to all types of legal persons, and has massively introduced overseas' advanced experience which make the bankruptcy system of our country step out a stride, but regrettably, for the lack of individual bankruptcy in the content, the new Enterprise Bankruptcy Law is vividly described as "Half Bankruptcy Law". At present, with our commodity economy's high speed development and international economic exchanges increasing day by day, individual bankruptcy question highlights gradually, and suspends in front of people. Whereas, the present research to this question of the academic community has still paused at a preliminary stage, and the relevant study is far from thorough and comprehensive. Based on the above, after conducting research on individual bankruptcy legal system, the author has composed this paper.
