Online games industry is developing rapidly in our country these years, which creates a few hundred million dollars in sales, and also promotes the development of relevant industries. But there is no regal norm to regulate the huge industry, which is being called the spread of the game without rules. In reality a large number of network-related disputes have become the focus of attention. China's online gaming legislation has lagged far behind in the development of online games; it has brought many inconveniences to the judicial practice, and couldn't protect the legitimate interests of gamers fully and effectively. Therefore, relevant departments should formulate laws and regulations to maintain trade order and promote the development of the industry as soon as possible. Research on civilian problems and rules in these deals will develop the visual field of traditional civil law and at the same time, the traditional civil law's theory could be applied to the online games'zone.On the foundation of the results of present research, the author makes an introduction of the concept and the characters of the online game. Then make an illustration of China's online game market and the legislation about this market. The author also analyzes the problems which remaining in the process of regulating and supervising the online game market. The problems not only exist in the legislation about online game's market but also emerge during the developing of this market. At the end of this paper, the author presents three advises which can improve these problems. First one is make a concrete concept of the legal nature of Virtual Property. Then, make a clear concept of the obligations of online gaming operators and the rights of players. The last one is make sure how to qualitative the act of"personal server"and "plug-in" and also how to fight these illegal acts.
