The Research Of Karaoke MTV Copyright Management

Copyright management is the important means to build creative community and ensure copyright owner's fervency and benefit. Now, society pays close attention to the event of Karaoke copyright charging. Ministry of Culture and Copyright Bureau respectively announced their Karaoke copyright management method and charging mechanisms, but all of two mechanisms have received the intense questions and criticizes. This thesis take this illustrative case as the object of study, make research on the Karaoke copyright management and the charging mode ,at last ,we proposed a proposal about Karaoke copyright management and the charging mode.As the basis of research work, through case analysis method, this thesis analyzed the music copyright's legal attribute of MTV used in Karaoke, induced the current situation of Karaoke copyright management in our country. We discussed on the community policy and government function of the Copyright Bureau and Ministry of Culture in this event, and given some valuable corresponding conclusion. According to the third department theory, we take more deeply research on the role of government departments(the first department) and copyright collective management organizations and entertainment profession associations(the third department) in the event of Karaoke copyright charging, and summarized the questions of copyright collective management organization. Finally this thesis studied the copyright charging mechanisms which respectively proposed by Copyright Bureau and Ministry of Culture. This thesis made a conclusion which copyright collective management organization should play more important role in the Karaoke copyright charging. At the same time, this thesis proposed a new charge mechanism which take proper attention to not only fairly but also efficiency. At last, we proposed some valuable suggestions which further consummate the Karaoke copyright management of our country.
