The Employment Of Hearing System In Prison Management

The first part of this thesis focuses on arguing the necessity of introducing the hearing system to prison management from the point of view that modern prison is realizing the objective of execution, guaranteeing criminals' human rights and standardizing the execution of public power. Besides, this part also discourses the feasibility of introducing the hearing system to prison management from the angle of social background, the promotion of government, the development of science and technology, the increase of people's sense of participation and the active exploration of prison leadership. The main content of the second part is about the existing law, relevant hearing rules of prison management, and some activities similar to hearing conferences which have already been used in domestic prisons, and its hearing admittance, starting of hearing, execution process and efficacy of hearing notes from the aspects of rules of surface and practice in prison. This part also makes some empirical study and analysis of hearing rules of prison management and those activities similar to hearing conferences. The third part analyzes and reasons the sphere of application of substantive hearing used in prison management, and clarifies the principles, processes and specific rules of hearing system used in prison management.
