Study On The Chinese Administrative Protection System Of Intellectul Property Rights

Intellectual property rights protection is the core of Intellectual Property Rights System. With the rapid development of the world economy and intellectual economy, intellectual property rights development, utilization and protection has been arousing an increasing attention and most countries has established their own intellectual property rights system.According to the law of our country, intellectual property rights is one of the most important civil rights. So, it is generally believed that protection of the intellectual property rights protection and the disputes over it should be resolved through legal means. However, intellectual property rights is of obvious public interests, which can be best reflect in its development into public right. Most actions breaching the intellectual property rights harm the interests not only of its owners but also of the public, thus making it necessary to protect it. Further, the difficulty of the intellectual property rights protection is facing renders it indispensable to establish a comprehensive protection system consisting of civil, administrative and criminal protection.Practice and experience tell us it is an integral and important aspect of the intellectual property rights property of our country that the government administrative organs in charge of intellectual property rights protection perform their duties according to then-power and legal procedure.The thesis first discusses the general theories, its main content and practice of administrative protection system of intellectual property rights protection of our country. Then is followed in the second section the analysis from various angle of the necessity of the administrative intellectual property rights protection in china. The deficiency of the present administrative protection system is dealt with in the third section. And finally, I am bold enough to come up with some suggestions and ideas on how to improve and optimize our country's administrative protection system of intellectual property rights.
