The Jurisprudence Thinking About Lenin's Theory Of Ethnic Equality

Ethnic equality is the thinking essence of Lenin national law, At the same time, he is also a practicer of this theory. Different from the form equality of the neoteric Western bourgeoisie, Lenin put more emphasis on the"equality in fact"between peoples, equality in fact is that protecting the basic rights of all minorities, building a national legal system of socialism. Lenin's national law thinking for the national legal system of China's socialist construction, in particular, for China's legal construction in ethnic minority areas is of great theoretical and practical significance.This paper bases on the principle of the Marxist historical materialism, taking the approach of a unified history and logic, and making the analysis of jurisprudence to Lenin's thinking on the issue of ethnic equality , to clarify that Lenin's ethnic equality theory is a kind of " equality in fact " theory beyond bourgeois "form of equality" .This paper seeks to China's social transition on how to address the new situation of ethnic equality to provide theoretical support and learn from experience. And further concluded: only under the principle of ethnic equality, according to Marxism-Leninism and the legal system of national equality to construct the China's socialist national legal system, to improve the regional ethnic autonomy as the core of the national legal system, to develop China's minority areas of political, economic and cultural and protect the rights of minorities, that could we ultimately achieve the common prosperity of all ethnic groups.
