Studies On Civil Self-admission System In China

The self-admission system is a crucial system that can promote litigation efficiency and benefit, which has been greatly emphasized by theoretical and executive circles in many countries. However, under the influence of china's traditional lawsuit attitudes and limitations of authority lawsuit pattern, and people ignore the value of procedure, the system lacks of powerful guarantee. In china, there are a lot of problems existed in self-admission system, such as misunderstanding of nature of self-admission, confusion to the object of self-admission and legislation, all these phenomena are not consistent with the smooth course of china's civil lawsuit and the reformation of civil action. Therefore, this thesis researches from the deep basis of the institute of self-admission, in comparison with the relative systems in civil law and common law, the author probed into the limitations and causes of china's self-admission system, proposed the idea of establishing china's self-admission system, that is, to establish the self-admission institution in legislation and support the system in procedure.
