| The issue of supporting in China has been more subject to the concept ethics for a long time than to the adjustment of the law. Until now, there are still not many people who regard the rearing among family members as a legal issue. In the judicial practice, the fact that the cases taken to courts in terms of upbringing issue constitute a relatively small proportion in family cases can fully proves the point mentioned above. However, with China's transforming from the agriculture society into the industrial society, the concept of family is becoming faint and the cases of abandoning persons who should be cared happened frequently. Therefore, concrete stipulations should be given to the relationship of rights and duties among family members in the level of the law. The system of supporting plays important roles in fully realizing the function of family's taking care of the aged and bringing up the young, guaranteeing the legal rights of the weak, stabilizing marital and family relationship and build the harmonious society. The present system of supporting in China is based on domestic situation, reflecting Chinese national's good tradition and strives to be in line with the international practice as well. However, it is insufficient in legislative framework and contents. The paper adopts various research methods of historical study, comparative study, annotation study and experimentation study. First of all, starting from the definition of the supporting, the paper makes an analysis of the value of supporting system from multiple angles. Secondly, it makes a systematic and deep research of existing problems in our country's present supporting system. Finally, the paper combines the developing tendency of our country's supporting system and puts forwards concrete legislative suggestions on perfecting our country's supporting system from the aspects of the scope, order, degree and ways of supporting.
