The Study On Legal Issue Of The Enticement Dete Ction

With the development of society, the increasingly complex criminal cases is already a reality which can not be ignored. All kinds of new types of crime, such as drugs, bribery, money forgery, smuggling and so on has been a huge challenge to the traditional investigation, all because of their high degree of concealment, and the superb organization of the anti-investigative techniques, so all kinds of special investigative methods came into being.The enticement detection has proved to be one of the effective measures that uncover the difficult cases.Today in many countries, enticement detection has become the investigated institution's favor for its good performance.However, due to the lack of the explicit legal regulations, its validity has been a controversial issue. Although the enticement detection has been in existence in China's practice of the criminal investigation, our country is late to this question's research ,and still lacks of unified theories and viewpoints of support, thus causes confusion in the practice.This article begin with the enticement detection's concept,analyse the foundation of the enticement detection system, on this basic the author elaborated our enticement detection's issue existed in the theory and the judicial practice. Finally,the author proposed improvement of our enticement detection.
