Barter is a kind of archaic form of trade. It was restricted by time, space and the asymmetry of need, so it was almost completely replaced by the monetary trade. The reincarnation of barter trade is along with the development of network and computer technology. Now barter trade has become a rapidly growing form of trade in the international and domestic market. The development of barter trade also acts actively in China. In the aspect of domestic trade barter could release the pressure of overstock, triangle debts and the shortage of cash. In international trade, it could save our foreign exchange and could help enterprises entering overseas markets. Especially nowadays, as a petroleum importing country, we can release the pressure of high price of oil and utilize the resource efficiently through performing the barter trade of"project oil exchanging"with petroleum exporting countries.The system of technique and law are required to develop the barter trade to be carried out successfully. In the technique aspect, the circumstance of electronic commerce is the chief point, and the electronic barter market based on electronic commerce needs to be constructed and improved. In the construction of legal environment, the subject of law should be concerned. In this part it should constitute the admittances of the barter trade exchange and barter trade corporation, and the rights and obligations of each should also be concerned. In the conduct of barter trade, the contract object , the electronic contract and assurance of barter should be regulated. The foundation of the government control and guild of barter trade should also be regulated systemically and comprehensively.
