Construction Of Judge Assistant System In China

"Justice and efficiency " is the topic of court work.There are a lot of problems in courts of china, including the ordinary style of judges . the way of solving the problems is construction of professional judges . The construction of professional judges is the important symbol of modern judicial civilization and the basic characteristic of modern country under the rule of law .The People's court moves toward the professionalism path of judge, is the request inevitably of socialism government by law idea, is the historical necessity of Chinese government by law development. As important action in judge professionalism advancement, judge assistant system's implementation and the effect has the very important influence on the professionalism construction of judge.This article has four parts, I proposed some rough views regarding the judge assistant system's present situation and the consummation. The first part is mainly the questions which we meets and the situation of judiciary, and proposed that judge assistant system might solute these questions effectively, and further proposed the judge assistant's concept.The second part is mainly the inspection of judge assistant system in American and French. Although judge assistant system is different in various countries, but system's spiritual essence is the same, has the common characteristics, namely judge occupation outstanding person and judicial business's fine refinement. Also proposed that the overseas system is only one kind uses for reference, cannot imitate, what we study is their idea, but is not the form. We must unify our country's national condition to formulate our own judge assistant system.The third part is the practice of judge assistant system of some Grass-roots court in china, various courts formulate respective judge assistant system according to own different situation. Author has carried on the summary to the experiment, and answered the questions which has appeared .The fourth part of author has further analyzed the questions which how to consummate the judge assistant system. Including related system's coordinated reforms; Judge assistant's origin, assignment condition, treatment and so on; Judge assistant and judge's relations; Judge assistant's management and so on.
