Research On The Relationship Between Arbitration And Court Trail In The System Of Labor Disputes Resolution In China

As we know, labor right is one of the basic rights given by our constitution, and should be protected as other rights. The labor disputes resolution system is the sign of the legislatures perfect or not, and the labor legislatures are closely related with reality. Unfortunately, as our society moves on and the build of the system of marketing economy, the labor disputes are changed more and more complex ,and the present system of labor disputes resolution which involves mediation,arbitration,and two court trails has exposed more and more limitations. Thus it is very necessary to adjust and perfect the relationship between the arbitration and court.The article analysis the problems existed in the disputes resolution system, and propose some proposals according to fair, justice and efficiency, then the author analysis the present situations and problems of the arbitration and the court trail; based on which propose the thinking and proposals on our countries system of disputation resolution, according to the other countries experience.
