As one of the most central parts of composition in the area of the modern economic law, Anti—Monopoly Law is the indispensable and basic legal system for each country to develop the market economy. Whereas the prescription towards monopoly agreement is one of the most central system of Anti—Monopoly Law among different countries. In this paper, comparative analysis of research methods, learn from Western countries in the theoretical results and legislation on the basis of experience, our country has just promulgated the "anti-monopoly law," the relevant provisions of the concept of horizontal monopoly agreement, constitute elements, classification, application Principles and legal consequences to assessment, also pointed out that China's "anti-monopoly law" horizontal agreement on the legal responsibility of anti-monopoly law enforcement agencies set up the inadequacies of the existing provisions, as well as horizontal agreements exemption procedures system deficiencies. On the basis of this, the author made the following points improve our system of horizontal agreements and recommendations: 1) the introduction of foreign punitive damages system, 2) the criminal provisions of horizontal agreements, 3) set up a special independent authority of the anti - Monopoly law enforcement agencies, 4) established system of horizontal agreements and exemption procedures; 5) improve the system of leniency.
