The study on the judicial independence and press supervision is a trendy and sensitive subject, which is based on the public's growing awareness of rights and the growing expectation for democracy and legal system. It has no longer been a mere ideal to restrict power by availing rights. That the freedom to supervise judicial independence by the press arising from the rights to express, to know, to criticize and to suggest is a power or a right, and how to maintain and avail this kind of freedom to give its fully play in the present legal system in China are the important aspects to which this thesis is primarily dedicated. In this study, we have really approached behind the judicial independence, to further explore what support this independence, how the press supervision function shall place itself in this independent pattern so as to assure that it goes smoothly under the press supervision. In the study of this issue, major trends related to this issue have been incited for comparison and contrast from all over the world, with more efforts given to the analysis of China's current situation. This paper will directly benefit the clarification of the free mind of the public, the weakening of the conflict between the justice and the media, and furthermore, to find a way for harmonious co-existence of the two factors.
