Research On The Legal Regulation Of Police Prompt Coercion

This paper first analyzes the abuse of police prompt coercion. In order to regulate the use of police prompt coercion, to strengthen the protection of the public rights and interests, to enrich the theoretical structure of the subject of law, and to guide the police law-enforcing practice, it argues the necessity of police prompt coercion on the premise of relevant concepts. Through the review of the legislation condition of police prompt coercion, it analyses several existing problems in this field and studies the legal regulation of police prompt coercion from the aspect of the whole legal system. Guided by the principles like the priority of law, the reserve of law and positiveness,the writer comes up with the concept to establish the police prompt coercion system at all sources of law. This paper insists that the use of police prompt coercion should obey the object of public interest, the choice of method should be in proportion to ensure the minimum fair procedure. It also analyses the litigiousness and the types of law suit on police prompt coercion, and gives suggestions to complete the protection of the rights and benefits of the private party.
