With continuous development of city construction in china, it is inevitable that there exist contradictions and conflicts in booming expropriations. The violence against forced expropriation is recurrent when the house owners can't make an agreement with the expropriators. What's more, some people protected their individual interest from robbing at the expense of their lives. These all resulted in more intense and acute conflicts between two parties.The recompensing for house owners' loss is an outstanding problem which is a key to solve all the problems occurring in course of expropriation. The compensation is involved with interest of local governments, the expropriator and the expropriated, and especially confronting the expropriated, the other parties usually integrate as a whole, by which it's very convenient to exert their powerful power and economic influence on the expropriated to restrict or expropriate their interest, so it is hard to deal with the balance of interest in between them.To smooth it away satisfactorily, the enacting, for one thing, should define public interest, normal of compensation, real of compensation and compensated persons in solid law so as to base expropriation on law. For another, enacting operational normal and procedures to better put solid law into practice. Furthermore, two parties must be perseverant in complying with the principle that they are equal to each other. Only in this way can agreements stand for each party's willing.The compensation, in practice, is flexible balance among three parties. In order to maximize interest of all parties, we are supposed to evaluate all kinds of interest via legal approaches.
