The Research Of Civil Conservatory System In China

The institution of civil conservatory is an indispensable and crucial system in civil action. However, China's current civil conservatory system only includes conservatory of property, no doubt this institution has achieved a lot in maintaining social economy order, and in preventing and striking illegal fraud behaviors, but with the establishment of socialist market economy, china has promoted its opening and reformation degree, especially after China enters WTO, a large amount of new-pattern civil disputes has also appeared. On the background of this situation, the institution of conservatory of property has apparently showed its posterity in theory and practice. In order to resolve this problem and serve for the socialist market economy, this thesis was researched from the concept,characteristics and function of civil conservatory, compared with the civil conservatory of two large law system, in analyzing our current limitations and existed problems ,the author put forward the idea of perfecting China's civil conservatory system.
