| With a premise that it provides the public with a reasonably reliable appearance of right in the form of registration, real property registration credibility breaks the de facto real property right condition, and then offers protection to the third party with good faith, pursuing a principle of transaction security prioritizing protection; and it is of vital importance for realizing a good utilization and circulation of the real property right, and for safeguarding the transaction security. In this paper, the writer, under the background of property ritht law, is to conduct a analysis of the theoretical foundation and construction of this regime, for the purpose of how to realize the real property registration credibility in real life, and dedicating a humble effort to the improvement of China's real property legislation.The paper consists of three parts: preface, main content and conclusion.The preface is mainly focused on an introduction of the background, and a brief presentation of the status of real property registration credibility research in China and foreign countries, then make sure of the orientation of my research.The main content is divided into four chapers. Chapter I first gives definitions on real property registration credibility, and on a basis of comparative analysis, comes to the conclusion that China in its wisdom has recognized real property registration credibility in the property right law; Chapter II explores the basic theories of real property registration credibility, mainly involving the choice in values, reasonable foundation and the premise of its existence; Chaper III is mainly focused on the concrete construction of the real property registration credibility, conducting a further and deeper research to the components of the regime, making it manipunative; Chapter IV focuses on some thoughts about China's legislation on real property registration credibility, through an analysis on the relations bewteen real property registration credibility and bona fide acquisiton of real property, holds that it is wise for our property right law to recognize the real property registration credibility, then analyzes the insufficiency of the legislation and approaches to improve it.The final part makes a summary of my conclusions, epitomizing the central ideas of this thesis. |
