As African special geographic environments and historical backgrounds, the scholars are accustomed to studing African law in accordance with the geographical features, and has made great achievements. However, like the colonizers dividing African countries'borders, they artificially fragmented the relationships of African laws.After World Warâ…¡, many socialist countries appeared in Africa . African socialism study has achieved success, but study of socialist constitutions is very scarce. Combined with the outcomes ,I will study the socialist constitutions using methods combining case studies with summed up the general, from the perspective of 4 schools of the village of socialism, the Arab socialism, the democratic socialism and the scientific socialism. Selecting representative cases, reveal the transplantation of the constitutions of the Soviet Union, China and other socialist countries , as well as the contents of the Constitution and its implementation in African countries.After the victory of the October Socialist Revolution,Russia had promulgated 4 Constitutions,which provided Soviet social systems and the basic principles. The 1936 Constitution was relatively mature,other socialist countries were greatly influenced by it,and it was a blueprint for other socialist countries to develop their Constitutions as guide.African socialism constitution included the basic rights and obligations of citizens, the state system,political party system,the basic economic system,the judicial system etc. African socialist constitution reflected the pursuit of independent and prosperous countries and had enormous impact on the evolution of the political power and the development of economic and social.They had transplanted the socialist system,also promulgated many socialist constitutions, but had not truly set up a constitutional government, which had historical reasons and practical difficulties;also the domestic political,the external factors of intricate international environment , the pressure of the superpower. But the most fundamental was the lack of the rule of law and constitutional environment. With the collapse of the Soviet Union, many African countries had begun political democratization. No matter how the democratization of African develops, the impact on the socialist constitution in Africa is undeniable, and in the process of democratization it will continue to integrate into the legal culture in Africa.
