The Balance Of The Conflict Between Freedom Of The Press And Protection Of The Right To Privacy

The freedom of the press and the right of privacy protection is modern society's product, is also the important social civilization symbol, therefore we must guarantee the freedom of the press and protect citizen's right of privacy. But looking from present reality of our country, on the one hand ,we need the news media very much to show the social dark side effectively the surveillance and to make public; on the other hand, the right of privacy is citizen's important personal rights. If only It is obtained the full protection, we can promote our country's legal system to further develop and to consummate.The first of this paper used the few lengths to introduce the concept of right of privacy and the freedom of the press separately first. Through understanding the essential factor as well as the connotation of right of privacy, we can know the importance of right of privacy .The second part of this paper firstly explained the present situation of the conflict between right to privacy and freedom of the press and finds that it's urgent to solve the problem. Then, we analysis the essence which these two rights conflicted separately from the social reality condition and the conflict between two right's value and attend the reason of the conflict .The third and forth part of this paper give us some principles ,ways and measures to balance the conflict between right to privacy and freedom of the press on the base of analyzing the reason of the conflict. For solving the conflict between freedom of the press and protection of the right to privacy, we should consummate the law of our country and increase the right of judges in the trial to balance the conflict.
