Citizens' Environment Rights Of Our Country On The Executive And The Legislature

After World Warâ…¡, civil environment rights has been risen along with the deterioration of the ecological crisis and the strengthening of the people's rights awareness and development of the concept, it was proposed in the 1960s in the developed countries ,then rapid became a new environmental era of human rights content. Many countries has adopted in a variety of environmental legislation to protect the citizens' environment rights ,some in the basic law of the country to make corresponding regulations of the citizens' environment rights s,some in the Basic Law of environment to make corresponding regulations of citizens' environment rights,in order to protect the environment right of citizens and resources better.Although China has been the law of the right of citizens environment, so far no clear provisions in the legislation to the concept of environmental citizenship, and not able to do its timely, comprehensive and thorough protection. Through comprehensive exposition of the right of citizens environmental background, the basic concepts and basic nature, and to study China's basic national conditions on the basis , I Think that as long as the strengthening of civil environmental executive and the legislature can better protect citizens the right environment. And on the basis of China's current laws,I try to discuss the legislative system design of the right of citizens environment.By the three major components:The first part is the environment right and the right of citizens environment comparison. the environment right is included in the right of citizens environment, environment right also including State environmental rights and human environment rights, civil environmental rights compared to the environment rights has its own characteristics.The second part is divided into the civil environmental rights to the status of the executive and the legislature. Although China has not yet clearly designed the concept of civil environmental rights in legislation stipulates, our current legislation has been in existence for a large number of civil environmental rights. Here we main analysis of the environmental legislation on citizenship and the right of existence of defects.The third part is the civil environmental rights of the legislature System Design. Here we main use of the right of citizens of the environment to explore the legislative system of our country's civil environmental rights.
