Unit crime is also called the corporate crime and the illegal person association crime. Although after the revision of criminal law, unit crime concepts concerned large-scale appear, the academic circles about the unit crime do not form the unified opinion. Therefore, in the unit crime domain, specially in the unit crime tenable condition, most basic questions such as the punishment principle and so on, still wait for the general scholars to do the further research.This article is for the purpose of comparing the general development tendency of the world corporate crime and the illegal person punishment. in this foundation this article tries to compare some viewpoints in our country present unit crime, and further reconsiders issues on our country present unit crime theoryThis article divides into four parts, the first part discusses several viewpoints concerned the unit crime concept and the unit crime characteristics; The second part elaborates several characteristics of the unit crime main body limits as well as the unit subject of crime; The third part discusses present situation of the unit crime discretion of punishment plot, and proposes my own viewpoint in this foundation; The fourth part has analyzed our country unit crime punishment related legislation present situation, and proposes suggestion of consummating our country unit crime punishment system.
