The Studying Of Criminal Subject Of Corruption

The criminal subject of corruption crime is one of the essential components of the constitution of corruption. Ever since its establishment before the founding of new china, it has been amended several times because of the constantly changing politics,economic systems and social life. And the recognition of the criminal subject of corruption crime has ever been a kotty problem.Because the provision of Penal Law is abstract and general.The author of this dissertation starts at the legislative history of criminal subject of corruption crime and focus on the provision of the criminal subject of corruption crime in Penal Law to study the subject. The paper consists of four parts:The first part introduces the legislative history of this crime ever since the establishment of new china,compares and analyzes the legislative, judical explanation concerned in various period and foreign laws of corruption crime.The second part is about the essential characteristics of the subject of corruption crime. The essential attribute of the corruption crime subject is the basic asserting of criminal subject. Theory circle comments differently in this too.Author thinks that being engaged in the public affairs is the essiential characteristics of the corruption crime subject.The third part is the recognition of the subject of corruption crime, which is the core content of this article and is difficult to study .To some important concepts,such as the public service personnel,the state agency, the state personnel ,the accurate country staff,and so on have been carried on.The fourth part discusses the legislative weak points concerning this crime in the current of Penal Law and suggests to perfect it.The author suggests to revise the concept of corruption crime .The subject should be public service personnel.The last part is conclusion. The author of this paper concludes the whole dissertation and mentions some noticeable problem about the theory research and Practical judicatures.
