| With the gradual progress of legal sate construction, strength of punishing official corruption is still increasing, whether it is big tiger or fly, all are included into management range, while corruption crime is the harder-hit area of national staff, its research is always the hot point by scholar circle, whether it is the component, way of act of this crime or the research on corruption as well as research on corruption crime from perspective of statistics etc are all the new ideas on this crime.Firstly, this paper illustrates the connotation, nature characteristic and range identification of corruption crime subject. Secondly, this paper introduces the difference of confused crime subject:difference from distributing privately state-owned assets, difference from embezzling public funds, difference from duty encroachment, crime of theft and difference from crime of fraud. In this paper, we make research and analysis on related problems to crime of embezzlement, whether person with identity can compose crime with special identity with person without identity, whether person with identity can compose perpetrator with person without identity, situation analysis on internal and external collusion as well as person with different identities corrupt in the same unit. Afterwards, this paper makes analysis on the legislation defects if corruption subject in China:the crime subject on corruption in China is inconsistent with criminal object, the crime subject regulation of corruption in China can not carry out equal protection on economic identity in China, and corruption crime subject in China can not well balance crime subject of each accusation. In the end of this paper, we put forward perfect and detailed ideas and suggestion on problem of identifying corruption subject:the subject of revising corruption crime and making definition on corruption crime subject. It is hoped that this paper can have beneficial reference effect on problem research of corruption crime subject. |
