Study On The System Of Picking Up Lost Property In China

In our country ,the lost-property return system was simple ,the new property law perfect it ,but there are still some problems ,so it is urgency to us to make it better .In this essay ,the author is aiming at putting forward some suggestive measures to out country's lost-property return system by drawing on foreign law and the relevant researches made by scholars .In this essay ,the author employs a wide range of research methods, including historical comparison ,comparative analysis ,value analysis ,positivistic analysis and etc to introduce the lost-property return system and analyse the main problem in our country.This essay is composed of four parts:The first chapter mainly dates back to the origin of lost-proper return system and introduce two ancient legal orientations on the issue of lost-property return .Besides that ,the author also introduce this system in the history of our country.The second chapter is a detail account of the legislation of two major western legal systems on the issue of lost-property collection .In addition ,after a careful comparision and analysis on the regulations between China and the west ,the author points out the defects existing in the China's lost-property return system as well as the necessity to improve it.The third chapter is researching to the general problem of lost-property return in our country .Mainly discuss the right of the collectors have included claim to return of expense ,claim for remuneration ,possessory lien and ownership of lost property in some conditions.The fourth chapter introduce the advertisement of the lost-property return .It is uncertain whether a reward is unilateral legal act or contract or not .The author gives own point and introduce the reasons .In addition ,the author also concern the problem exist in the advertisement.
