The Research On The Legal Problems Of Shareholder's Right Trust In China

Shareholder's right trust is a kind of trust in which its fiduciary property is shareholder's right.It includes investment shareholder's right trust and management shareholder's right trust.In the first part, the thesis introduced the creation and application status of China shareholder's right trust system .This thesis deems that sharesholder's right trust have played an active role in the practice of economy in China.But there are some legal problems of shareholder's right trust system because the trust law system in China is not perfect,such as the lack of shareholder's right trust registration and insufficient disclosure of the informations of shareholder's right trust. The development of China's shareholder's right trust system is hindered by these legal problems.To solve these legal problems,firstly ,we should innovate China's shareholder's right trust registration system. Secondly, the trust obligation of confidentiality should be balanced with the disclosure of information control.Thirdly,we need a new income tax system of shareholder's right trust.Forthly,we have to regulate every step of shareholder's right trust process .
