Legal Review On Protection Of Intellectual Property Right-Right Of Pledge

As the development of the economy and the improvement of people's life, especially when the Knowledge-economy has been structured, intellectual property ("IP") plays a significant role in the modern society. As the U.S. futurist Toffler pointed out in his book the forecast and precondition, "In the third wave of society, we still need the tangible properties such as land, machinery, but the main property has become the information." As a property right, IP in the whole community property in a growing proportion of its increasingly widespread application. Using IP for financing guarantees would become spectacular natural areas. Currently, legislation in the different countries stipulated the pledge of intellectual property ("PIP"), so did PRC law. However, there are many problems, no matter the theoretical study or practice in PRC.In the field of theoretical study, the writer focus on the difference between the PIP and general pledge of right, and the difference between the PIP and other usage of IP.The Paper also gives a brief introduction of the practice of PIP in PRC.
