Study On The Financing Of Intellectual Property Pledge In Chongqing

The 19 th National Congress of the Communist Party of China clearly points out that we should speed up the construction of an innovative country,strengthen the support for the innovation of small and medium-sized enterprises and strengthen the creation,protection and application of intellectual property.The intellectual property pledge financing,as a kind of intellectual property right,can meet the demand of innovation funds for small and medium-sized enterprises,so it plays an important role in the strategic planning of 19 th Five-Year.As one of the municipalities directly under the central government,the Intellectual Property Office of Chongqing has vigorously promoted the reform of the intellectual property market in recent years,introduced relevant policies and measures,and continued to increase the amount of intellectual property pledge,but the enterprises involved in the pledge have been slowly increasing,and the reasons for it are worth studying deeply.In this thesis,the author take the research data of Chongqing on intellectual property pledge financing,which is from 2010 to 2017,as the research samples,to explore the existing problems in the process of practice,and in-depth analysis of the reasons for the problems,and on the basis of practical experience,to put forward feasible suggestions on the basis of the practical experience.The main body of this thesis contains the following seven parts:The first part is about the introduction.This section describes the background,significance of the topic,research methods,the overall framework,as well as the innovation and application value of this thesis.The second part is about an overview of the financing of intellectual property pledge.This part expounds the definition of intellectual property pledge financing,the existing legislative system and the whole development process.The third part is about the status quo of intellectual property pledge financing in Chongqing.This part is a description of the results of the survey,first of all,statistics of Chongqing from 2010 to 2017 of the intellectual property pledge financing data,and then the corresponding policy support,the patent right as an example of the intellectual property pledge financing process detailed solution,and finally,the Chongqing city of intellectual property mortgage financing service platform for the typical display of Chongqing to open the city.The financing mode of intellectual property rights pledge.The fourth part is about the problems of intellectual property pledge financing in Chongqing.In this part,we first analyze the survey data,and find that there is a low degree of enterprise participation in the process of practice,focusing on large scale enterprises,uneven distribution of pledge amount and pseudo mortgage.After in-depth analysis,it is found that there are many reasons for these problems,such as the difficulties in the evaluation of intellectual property rights,the risk of intellectual property pledge financing,the lack of real marketization of intellectual property pledge and the misunderstanding of the amount of the pledge of pledge.The fifth part is about the practice of intellectual property pledge financing inside and outside the domain.This section first summarizes the practice of intellectual property pledge financing in the United States,Japan,Germany and South Korea,and then analyzes the practice in the region,so as to provide some experience for solving the problem of Chongqing’s intellectual property pledge financing.The sixth part is about the feasibility of promoting the development of intellectual property pledge financing in Chongqing.This section first clearly solves the problem,and then puts forward the feasibility of introducing the patent right evaluation report pre pledge system,the new patent value evaluation system and the calculation method,the patent license income pledge system and the perfect service system,hoping to better promote the development of Chongqing’s intellectual property pledge financing.The seventh part is about the conclusion.This part summarizes the research results in this thesis and forecasts the future research.
