Judiciary independence and media supervision are the two integral and basic elements for a modern democratic state of law. The value of balance ,the coordination of functions, the allocation of resources and the setting of system between them are the problems that any modern country under rule of law must face. They not only reflect the basic characteristics of a democratic society, but also show its difficulties and problems.The media ,as the "fourth power", are producing more and more impact on a country's political, economic and social life. Meanwhile, media coverage as a moral constraint ,sometimes can possibly produce "the tyranny of the majority ", and interfere with the administration of justice, thus bringing out the profound conflict with the judiciary independence and professional process of judges. This conflict is the reflect of the inherent contradiction that exists in the constitutional mechanism of democracy, and will still end up with using the standard of "judiciary justice" for the balance between "media supervision" and " judiciary independence . "This thesis attempts to identify the cause and essence of the conflict between judiciary independence and media supervision by deconstructing the relationship between Chinese media and judiciary ,and to propose a more reasonable system design for the outstanding issues existing in the process of the media supervision over judiciary, hoping to make some contribution to the study of the reasonable construction between media and judiciary.
