Primary Study For Remedy Procedure Question Of Trade Secret Tort

Legal channels to protect trade secrets are not only an important part in China's intellectual property system , but also the most effective and authoritative means of our country's commercial secret infringement relief and the basic way for protection of commercial secrets. In the use of the proceedings to protect the trade secrets, only constant criticism and correction of the flaws of its own procedures and taking full account of the effective protection of commercial secrets can eventually achieve the commercial secret infringement relief purposes by adoption of the proceedings. Therefore, the author of the paper specially and separately study and research the commercial secret infringement relief procedural flaws to more clearly understand and grasp the profound impact of related litigation system on the substantive law, so as to propose amendments and improvements of the litigation system supporting the substantive law in a targeted manner.
