Study On Legislation Of Electronic Evidence

As a result of the modern information technology, Electronic evidence,'the king of evidence in the information world', plays an irreplaceable role in cases. Although electronic evidence has been adopted in juridical practice step by step, man of law still treat it carefully, even'disoriented'. This Phenomenon is due to the impact and challenge of electronic evidence to the traditional evidence rule, as well as the lack and lag of the electronic evidence legislation and rules. All these hinder the application of electronic evidence. First of all, the thesis analyzes the electronic evidence from its meaning, characteristics and legal status in a scientific way. Secondly, the thesis makes a detailed evaluation and consideration for the legislation pattern in comparison law vision from a deeper level. Meanwhile, the author introduces the international and domestic electronic evidence legislation briefly. Besides, the thesis evaluates the obstacles faced by electronic evidence in China. That is there are so many conflicts between electronic evidence and the present procedural regime those needs to be solved by legislation in future. After a lot of rational review, the core problems faced by electronic evidence legislation are analyzed in more profound, hoping to provide some help and suggestions to improve the related legislation. Finally, based on careful proof and analysis, the thesis raises a prospective scheme for electronic evidence legislation mode in China, engaging in offering some reference for pushing the related legislation forward.
