With our nation's increasingly economic devdlopment,numerical rising of a variety of vehicles and rapid construction of highways,four kinds of index indicating the rate of traffic accidents are on rise year by year. Traffic accidental misdemeanor,one kind of involuntary crimes takes on the tendency towards the high peak.In a long way,it is necessary to further adjust and perfect the procedures of evidence collection,case proceeding,evidence and law application. So it is a very significant thing to study evidence collection and application of traffic accidental misdemeanors. Since the issue and coming into effect of Road Traffic Security Act of PRC on May 1,2004,a set of traffic rules and stipulations concerning road traffic security has opened up. Acts and rules'perfection step by step as well as people's legal sense being raised makes further requirements of raising the law-enforcement level and comprehensive nature to all the law-executors especially in root class. This article attempts to study and criticize all kinds of theory and practical problems existing on present transaction of traffic accidental misdemeanors through the way of analyzing the evidence collection and application in actual cases,and to raise my programs for perfecting traffic incidental misdemeanor transacting procedures in order to promote the social harmony and stable.
