Research On The Constitutional Protection Of Prisoners' Human Rights

The human rights first is the weak community's human rights. Under the power of Penalty,the prisoners are weak community. As the national's fundamental law, the objective of the constitution law lies in to limit the public authority and to protect the private right. This article studies on the constitution protect system of our state,from the protection of criminal human rights . At first, the foreword limits the definition of criminal human rights and elaborates significance of the protection for the criminal human rights. on this foundation , reconsiders the constitutional system of our state which have inadequates on the criminal human rights,then proposes some tentative plans on consummate constitutional system of our state . The first chapter states of the origin of human rights offenders, offenders of human rights on the basis of defined systematically analyze, and of relevant concepts and analysis shows that the human rights of offenders is part of the human rights system. which is a special kind of human rights groups. Chapter II on the basis of this analysis of the situation of human rights offenders and the constitutional guarantee of the special value, strengthening the embodiment of human rights and security, not only for the protection of the rights of offenders. but from the overall strengthening of the rights of all citizens to protect and promote the construction of a harmonious society. Chapter III state the United Nations and Western countries in protecting the human rights of offenders for an overview to our state to improve the rule of law and provide some suggestions and references. The fourth chapter elaborates on the current Constitution and the relevance of constitutional law in the protection of human rights offenders shortcomings and deficiencies, highlights the country's constitutional system and the need for improvement in urgency. Chapter V is our constitutional right deficiencies raised some perfect vision Rights of criminals from the constitutional recognition of all constitutional laws and improve the application of the Constitution were discussed and the National People's Congress unconstitutional and the courts to sanction the illegal jurisdiction combination of unconstitutional censorship.
