The Research On Victim-Offender Mediation For Juvenile Delinquency

The VOM for juvenile delinquency is an important part of contemporary juvenile justice, and a new measure to deal with juvenile delinquency which becomes more and more serious. It is a kind of procedure to solve criminal cases committed by juvenile offenders and other issues caused by these crimes, which needs specially-trained mediators'participation, through negotiation between the juvenile offender and the victim.Since the late of last century, the practice of VOM for juvenile delinquency has been developing vigorously with the notion of mediation'introduction to juvenile justice. To strengthen relevant research and to promote the construction of the system of VOM for juvenile delinquency will be of significance to sum up practical experience, promote diversification of the juvenile delinquency–settlement system, strengthen the protection of victims'right, and help juvenile offenders to turn over a new leaf.The article is composed with four parts. The first part will review the beginning and development of the VOM for juvenile delinquency, and identify the two value orientations of this system, which are mediation justice and the principle of non-punishment. The second part will introduce the practical experience of America, Netherland, Norway and German, and draw out some important inspiration. The third part will choose three provinces (Peking, Shanghai, and Hunan) to introduce the current situation of VOM for juvenile delinquency and analyze the Characteristics and the problems of the VOM practice in juvenile justice in our country. On the base of drawing other countries'practical experience, integrating our country'achievements in practice, confirming the basic idea for the construction of the system of VOM for juvenile delinquency in our country, the last part will do some design for the system from three angles: the fundamental principles, the premises of application, and the procedure.
