During the past several years, there have been more and more complaints about the quality of commercial housing. The defects and flaws are relatively clear and cause more and more conflicts between customers and sellers. Commercial Housing defects not only cause a decline in the safety and endurance of the houses, but also cause environmental pollution and a waste of resources. Sometimes, defects can cause serious accidents. Defects have become a focus topic which affects people's body and minds and even construction of a harmonious society.Although defects of Commercial housing have many causes, the morbidity of the relevant law system is one of the most important reasons. In the regulations of our country, the regulations concerning the quality of commercial housing are dispersed among the lower administrative levels. Most of them are administrative codes and administered rules except for the Construction Law of the People's Republic of China and Law of the People's Republic of China on Administration of the Urban Real Estate. The lack of a basic, uniform, law codifying the quality standards of commercial housing results in the inability of the law system to reliably guarantee quality standards. To build and perfect a Commercial Housing Quality Law system is an urgent task for us. We need to further study the state of the current Commercial Housing Quality Law system and to analyze the legal reason for the quality problems so as to find a method to regulate commercial housing quality.The dissertation consists of 4 chapters with the following contents:Chapter 1: Existing defects of commercial housing and reasons thereofThe defects of commercial housing have become a focus topic which affects people's body & minds and even the construction of a harmonious society. This chapter classifies the defects based on the main defects found and according to diverse standards. Meanwhile it introduces the main and direct causes of commercial housing defectsChapter 2: Regulation defects for commercial housing qualityThis chapter looks for the legislative causes for defects in commercial housing. It enumerates the provisions of the current laws in relationship with the defects, and analyzes awareness of the laws, the law system and performance. It points out that main reasons for commercial housing defects are lack of awareness of the law, the lawmaking administrative levels are too low, and the penalties are not severe enough. Based on the analysis, it concludes that the main reason for commercial housing defects in our country is that there is not a Commercial Housing Quality Law which can regulate the quality of commercial housing.Chapter 3: Jurisprudence accordance, and principle for regulation of commercial housing qualityThis chapter provides a theory for constructing a law frame to analyze the regulation for commercial housing, sets fundamental principles for that law which and rights protection of the commercial housing customers, assorting with the real estate development and continuous development and further more set a solid foundation in theory for the construction of the commercial housing quality regulation.Chapter 4: Perfect the construction of the system for the regulation of commercial housing quality in our countryThis chapter discusses the details for the construction of the law frame for regulation of commercial housing quality in our country based on the above stated defects and reasons, legal arguments in accordance with jurisprudence and principles. It includes four aspects which are: a project general contracting system, an inspection system, quality liability and supervision, quality guarantee and insurance system. When the said systems are finished, the legislative regulation for commercial housing quality will take shape.
