Bribery crime, a traditional type of crime, is a typical identity crime. The subject of bribery crime must have a specific status. As for the subject with what kind of special status, it varies in different countries and regions, even in the same country of different historical periods. China has always attached great importance to the fight against bribery crime. Based on different guiding ideology, the definition of the scope of the subject is also not identical in different historical periods. With the development of Chinese social economy, how to determine and grasp the specific scope of the subject of bribery crime is a very complex issue, whether from the view point of current judicial practice, or the perfection of criminal legislation.This present study, a multi-aspect and multi-angle comparative investigation focusing on the subject of bribery crime, tries to carry out an in-depth specific analysis on the scope of the subject of bribery crime in Chinese current Criminal Law, through the comparison and reference of Chinese legislative evolution after the foundation of PRC, and legislation in various countries. A view point is also proposed in this study with the combination of some hot issues presented in the current judicial practice; for example, whether those persons, such as general doctors in state-owned hospital, football referees, journalists, national missionaries having retired but still working in official service, national staffs after the demission and so on, may become the subject of the bribery crime.
