The key issue concerning the damage of public facilities lies at the principle of its liability attributing. However, there is not much work done in this field.This thesis first gives an introduction to existing problems as well as the negative influence caused by liability attributing. Then it focuses on the causes of this controversial issue and analyzes it in great detail. Based on the research on the legal nature of public facilities damage as well as drawing on relevant overseas experience, the thesis then propose that liability without fault is applicable to the current issue and tries to prove this statement in terms of theory, economic analysis and its plausibility. Last, it addresses the construction of a responding operating system to liability without fault, hoping to provide some insights into the complexion of Public-facilities-tort System...
