Defect Product Recall System In USA And Its Revelation To China

Recall system of defective product originated in the United States. By far, Recall system in U.S. is the most advanced and complete in the world. it has standard system and rigorous procedure, and it's of high operability and frequently implemented. Therefore, studies on the recall system in U.S. has the most theory value and practical significance. China only has department regulations about recalling in motor vehicles, foods, medicines, children's toys these four specific fields at present. But the implementation of departmental regulations and the formulation of the new law "Administrative Provisions of Defective Product Recall " need more literature references.This paper divides into four chapters. The first chapter will briefly introduce the meaning, the characteristics and its historical development of the recall system. The second chapter will give a fairly detailed introduction of recall system in US, including the authority, recall procedures and its main characteristics. Chapter three will explore the social background of the recall system, aims at better understanding of the recall system which runs in the whole social system. The social background will focus on the following perspectives, consumers' strong awareness of self-protection, punitive damages, safeguard function of the justice, recall policy of temper justice with mercy, fair, authoritative testing organizations, free evaluation of evidence, the value of enterprise reputation. This part will be launched at great lengths to supplement the shortness of the domestic literature and to raise more thought. Chapter four is the enlightenment from the recall system in U.S., with the hope that it can contribute to China's legislation, law enforcement and justice.As to research method, systems analysis runs through all the paper.
