The System Of Administrative Information Publication In The Angle Of Construction Of Uncorrupt Government

Previous Party congresses and political documents have repetitiously emphasized on the development of democratic politics and have raised the appeals for publication and opening of administrative information. We have applied the system of administrative information publication for more than one decade and have gained much practical experience; however, the progress of which is slow and there is much left to improve. Some serious cases happened recently call for the speedy legislation of administrative information publication. Thus it is necessary to study the system of administrative information publication in our county.It is common experience for countries all over the world to construct the system of administrative information publication, and many countries have built their own system on publication. What's more, the UN Convention Against Corruption has definitely required its member countries to construct"transparent government". Our government has been working hard on the opening and transparency of administrative information for a long time. All the people, who require to maintain their own legal rights, desire for an uncorrupted and efficient government, and have the strong wish to take part in democratic politic, will form a powerful restrictive strength to supervise the government and its organs to act by the law. The precondition of supervising is the guarantee of the knowing right of citizens towards the administrative information, otherwise the supervising is based on nothing.Practices from many countries have proved that this system is of significant importance on the progress of democratic politic and the effort against corruption. Quoted on Zhang Qiong, the pre-vice director of legal office of State Council, the system has following three functions. Firstly, it offers a way to let people know extensively about the obligation and purview of the administrative power, the procedure and result of administration, and the method of supervising. Thus it ensures the correct exertion of power without any abuse of it. Secondly, it is helpful to the construction of a system of anti-corruption and reduces the potential opportunity of corruption. Thirdly, it emphasizes on supervising of the society, broadens the channels for people to take part in the social management, guarantees the right of knowing, participating and supervising of people, and thus raises the level of self-monitoring against corruption of administrative public officers.Therefore, in view of reducing corruption and crimes by taking advantage of duty, the government should open administrative information as much as possible, which means, an uncorrupt government should firstly be a transparent government. Only if the government opens the information, can it furthest eliminate the corruption in the government.This thesis is composed of four parts to comment on the system of administrative information publication in our county. Chapter one summarizes on administrative information publication and the construction of uncorrupt government. Chapter two theoretically analyses on the reasons, advantages and disadvantages of administrative information publication against corruption. Chapter three offers some practical cases to testify the opinion. Chapter four, based on the analysis of the deficiency of the newly implemented Statute on Administrative Information Publication, proposes some advises and suggestions on the perfection of system of administrative information publication in our country.
