On Fine Penalty Of Juvenile Delinquent

Regarded as a worldwide problem, juvenile delinquency takes place more and more often. How to effectively prevent and reduce juvenile delinquency has become an issue for the whole world. Compared with adult crimes, juvenile delinquency has its own characteristics, so it shall be applied to different penalties. Under such circumstances, this paper focuses on fine penalty applied to juvenile delinquents as the subject. In our country, there are no profound studies and correct understanding on fine penalty, so in legislation there are no difference between fine penalties applied to adult criminals and juvenile delinquents regardless of the characteristics and economic condition of the latter. The flaw in the legislation results in the confusion in the judicial practice. On the one hand, the value of fine penalty has not been brought into full play. On the other hand, juvenile delinquency cannot be effectively punished and prevented.This paper begins with the value analysis of fine penalty regulations of juvenile delinquent, of which the goal is to educate juvenile delinquent and prevent juvenile delinquency. Then the paper analyses the current condition of legislation, judiciary and execution, and elaborate on the disadvantages of fine penalty applied to juvenile delinquent. It is meaningless in terms of educating juvenile delinquent and embodying the value of the fine penalty to apply fine penalty to juvenile delinquent, so it shall not be applied any more. At last, the paper suggests community service which suits well to the characteristics of the minors and is good for the minors to come back to the society as the penalty applied to juvenile delinquents.
