The Rational Analysis On The Application Of Technical Investigation In The Bribery Crime

At present,bribery crime has become the most important official crimes which the anti-corruption departments investigate and treat。The criminals can take increasingly hiding and cunning methods of committing crime;their counter-investigation and anti-trial experiences get even more and more rich;crime ways present diversification。On the contrary,prosecutorial organization undertaking the responsibility of bribery crime is difficulty in investigating such crime due to its relatively simple and outdated means of investigation。It results in more and more dark figure of crime。Technical investigation as a secret means of investigation is so emerged and applied in order to cope with the abovementioned situation。It is not only applied to investigate ordinary crimes,but also widely applied to investigate official crimes。China should endow its prosecutorial organization the right to use technical investigation to enhance investigation ability and attack bribery crime more effectively,being based on special requirements of bribery crime investigation and drawing lessons from relevant provisions of foreign laws and United Nations International Anti-Corruption Convention。This paper aims to elaborate basic theoretical issues related to technical investigation, such as its concept,characteristics and value analysis。It absorbs the foreign legislative and judicial experiences that are beneficial to us and it also analyzes the current situation of legislation and the necessities of the application of technical investigation to bribery crime。Based on the analysis above,the paper is trying to put forward some legislative proposals related to how to apply technical investigation in bribery crime in order to perfect the relevant legislations and crack down this kind of crime more effectively。...
