The Application Of Technical Measures In Duty Crime Investigation

The investigation ability for the duty crime is the embodiment of the ruling ability of the party in a country. These special job-related crimes not only infringe the integrity of office staff, result in the loss of state-owned assets, but also destroy the party and the government’s image, and even decide the success or failure of the party and the country. In recent years, China’s situation of the duty crime investigation is becoming increasingly serious, and there is the emergence of crimes with high intelligence,characteristics of concealment,anti-investigation ability. In order to adapt to the new changes of the duty crime, western countries mainly take the technical investigation measures to curb the duty crimes. But technical investigation measures have the risk of infringement, so many countries have passed legislation to regulate it.Taking the revision of criminal procedure law as an opportunity, this thesis discusses the present situation for application of the technical investigation for duty crimes and the legislative improvements. The first chapter discusses the basic theory of technical investigation; the second chapter discusses the problems in the application of technical investigation for the duty crime and the necessity of introducing the technical investigation into duty crime investigation; the third chapter discusses the legislative design on the perfection of technical investigation for duty crime investigation.
